The Carrollton man accused of driving drunk and killing an avid cyclist in a hit and run last fall has been indicted on 11 charges by a Carroll County grand jury.

Marrick Chad Stephens, 38, allegedly struck James David Grisham, 58, of Carrollton, while Grishman was bicycling along the Highway 166 bypass near the Highway 27 ramp about 3:45 a.m. on Sept. 21, 2008, according to Carrollton police.

Police said Stephens was driving a 2002 Mercedes-Benz ML500 intoxicated when he hit the cyclist and left the scene of the crash without stopping to help the fatally wounded man on the side the highway. It is believed, according to authorities, that Stephens continued to drive drunk until the sport utility vehicle he was in ran out gas.

Police said Stephens was arrested when he drove back in another car - still noticeably intoxicated - to where the SUV had stopped near the corner of Lovvorn and Ingram roads several hours after the incident carrying a gas can.

The grand jury presentments were returned Jan. 28 following a three-day session.

Grand jury findings are not a claim of guilt but a finding that enough evidence exists for the issue to go to trial. Anyone who is indicted by the grand jury should be presumed innocent until their case is decided by either a judge or jury.
